Privacy Policy

This Privacy Policy describes True Religion Apparel, Inc.’s and its parents’, subsidiaries’, and affiliates’ (collectively, “True Religion,” “we,” “us,” “our”) policies regarding the collection, use, and disclosure of personal information when you visit our website (truereligion.com), use the True Religion mobile application (“TR App”), shop in our stores, or otherwise interact with us. “Personal information” is information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked to a particular person. When you, or someone on your behalf, provide personal information to us, including through using our website or the TR App (jointly referred to as the “Sites”), creating an account with us, shopping with us, or otherwise engaging with us, you agree to our collection, use, disclosure, storage, and transfer of personal information about you as described in this Privacy Policy. This policy does not cover personal information within the scope of your relationship with us as a job applicant, employee, independent contractor, director, or officer. WHAT PERSONAL INFORMATION WE COLLECT, HOW WE COLLECT IT, AND WHY WE COLLECT IT

The personal information we collect generally includes: (1) information to provide our products (e.g., payment information, a shipping address for an online order); and (2) information that assists us in marketing our products.

We gather this information either from you directly, through partnerships with other companies, or via automatic data collection tools, such as online tracking technologies. Some of our collection of personal information is required to provide our products (e.g., payment or shipping information for an online order), so if you do not provide us with the requested information, we may not be able to provide certain products or services to you. In the last 12 months, we have collected the following personal information from the sources, and for the purposes, described below.

We collect consumers’ Internet Protocol addresses and other online interactions through online tracking technologies and marketing partner relationships, as explained more fully in the Digital Technologies and Targeted Advertising section of this Policy. To provide our products, data analysis, pricing, and for marketing purposes.
Geolocation data. We collect zip codes from consumers directly and may collect device geolocation data. To provide our products, inform consumers of the closest store, data analysis, fraud prevention, marketing purposes, and for legal compliance.
Audio, electronic, visual, thermal, olfactory, or similar information. In-store cameras and customer service phone call recordings. Theft prevention and customer service oversight and improvement.
Inferences drawn from any of the information identified in this chart to create a profile about a consumer reflecting the consumer’s preferences, characteristics, psychological trends, predispositions, behavior, attitudes, intelligence, abilities, and aptitudes. For purposes of this Policy:

  • information we collect “from the consumer directly” includes: (i) personal information you provide to us, for example, when you: purchase, exchange, or return products; provide us with your preferences; create an account; submit a form; interact with our customer service or Live Chat support; sign up for special offers, promotions, or programs (e.g., our True Fam loyalty or student discount programs); and (ii) information we collect using online technologies when you use our website or the TR App.
  • our marketing partners include third-party data sellers, lead generators, data analytics providers, and digital advertising partners (e.g., Google, Meta, other social media platforms).

In addition to the above personal information, we also collect anonymous, de-identified, and/or aggregate data that is not linked to a particular individual. Our use or disclosure of such information is outside the scope of this privacy policy. We only maintain and use such data in a way that does not identify a particular individual, and we will not attempt to re-identify it, except to test our de-identification process and ensure it cannot be associated with any individual.

We collect your personal information for the following lawful bases:

PERSONAL INFORMATION WE DISCLOSE AND WHY

The personal information we disclose about you depends on how you interact with us. For example, if you make a purchase, we may share your purchase history and personal identifiers such as your name, email address, postal address, payment and order information, and Internet Protocol address (if ordering online) with entities that help us process and fulfill your order, answer questions about your order, manage our relationship with you, or with our marketing partners. Even if you do not make a purchase, we may disclose information with our marketing partners. The below chart summarizes how we have disclosed personal information in the last 12 months, and why.

We may also disclose the above personal information in the event of a corporate transaction (e.g., a sale, merger, financing), as requested by you (e.g., to facilitate your use of certain credit-based payment forms), or for legal purposes (e.g., as required to do so by law, or in the good faith belief that such action is necessary to (i) comply with a legal obligation, (ii) protect or defend our rights, interests or property or that of other customers or users, (iii) act in urgent circumstances to protect the personal safety of users of the Sites or the public or (iv) protect against legal liability or potential fraud, in each case as determined in our sole discretion).

We do not use or disclose sensitive personal information for any purposes other than those permitted by law.


DIGITAL TECHNOLOGIES AND TARGETED ADVERTISING

We and our marketing partners use various online tracking technologies to gather information about you when you interact with the Sites, email communications, or other websites, apps, or advertisements. These online tracking technologies include technologies such as cookies (a piece of information placed on your browser when you access the Sites), web or hardware beacons (small pieces of data embedded in images and webpages), pixel tags, log files, local shared objects, and similar technologies (collectively, “online tracking technologies”).

When you visit certain websites or use an app (including our Sites), the online tracking technologies may collect identifiers (e.g., your Internet Protocol address or other online or device identifier), categories of personal information described in Cal. Civ. Code § 1798.80(e), Internet or other electronic network activity information (e.g., a record of your usage of our Sites or engagement with other content, and the time of your usage), geolocation data (e.g., your approximate location), and inferences about you. Such information is collected passively using online tracking technologies, both on our Sites and on other third-party sites you visit or whose products or services you use.

We use the information gathered via these online tracking technologies to maintain and optimize our Sites (e.g., improving security, fixing bugs, preventing website crashes), understand traffic and usage patterns, associate information with a particular user or device, personalize your experience (e.g., saving preferences, holding your shopping card selections when you leave the Sites without checking out), track other websites you visit or other online activity, and for marketing purposes (e.g., generating leads and tailoring our marketing efforts). Our partners (e.g., Google, Meta, and other social media networks) may also supplement this data with the same or similar categories of personal information they have collected about you. Our marketing partners disclose such information to us, and where we collect such information, we disclose it to them, for marketing purposes (e.g., targeting advertisements so individuals receive ads that are more relevant to them). Our use of targeted advertising does not increase the number of ads you see, only how relevant those ads are to you.

Cookies

We may use a variety of cookies on the Sites. Cookies may be session cookies (i.e., last only for one browser session) or persistent cookies (i.e., continue in your browser until they are deleted or expire). Some of the cookies we use may be flash cookies or Adobe cookies, which may contain demographic information and depending on your browser these cookies may not normally be deleted when your cookies are deleted. Please check your browser to determine where these types of cookies are stored and how they may be deleted. If you sign up for our text messaging program, cookies may be used to personalize your experience (e.g., send you personalized text messages such as shopping cart reminders). Among other cookies, we use Google Analytics and Google Ads. While we recommend that you leave cookies turned on, as they allow you to take advantage of some of the features of the Sites, you have the ability to control our cookies. Specifically, you can configure your browser settings to (i) receive notifications when you are receiving new cookies, (ii) disable cookies, or (iii) delete cookies. Please refer to your Web browser's help section for information on how to do this. Depending on where you live, you can also choose whether or not to accept cookies by using the cookie banner found on our Sites. If you elect not to allow cookies to be placed, you may not be able to use or to enjoy all of the services and features of the Sites.

Targeted Advertising

We may share personal information with other parties to provide analytics services and serve ads on our behalf targeted to your interests and based on your online activities. Information may be linked to your browser or device (like cookies and similar tracking technologies) and related to you if you have a customer account or interact with us in other ways. These parties may use the information for their own marketing and to offer products and services on our online services.

Your personal information is not shared for money, but our use and disclosure of your identifiers and contact information, commercial information, Internet or other electronic network activity information, and inferences drawn from such information, to marketing partners and analytics providers for marketing purposes within the last 12 months, could fall within California’s definitions of “selling” or “sharing.” “Sharing” is referred to as “targeted advertising” in some places. We do not sell or share personal information of individuals we know to be under 16 years of age.

If you are a resident of the U.K., California, Colorado, Connecticut, Utah, and/or Virginia, you may opt-out of our use and/or disclosure of your personal information across non-True Religion businesses, websites, and applications for targeted advertising purposes (“opt-out of selling/sharing”). California, Colorado, and Connecticut residents may use authorized agents to submit opt-out of selling/sharing requests on their behalf. To submit a request to opt-out of selling/sharing, you (or for California, Colorado, and Connecticut residents, your authorized agent) may call us at 1-833-878-5326, submit this webform, print the webform and submit it at any of our California retail locations, or use an opt-out preference signal, such as the Global Privacy Control (GPC) on browsers and/or browser extensions that support such a signal. Your decision to opt-out of selling/sharing will not alter the number of advertisements you see, only whether those advertisements are tailored to you. To download and use a browser supporting the GPC browser signal, click here: https://globalprivacycontrol.org/orgs. If you choose to use the GPC signal, you will need to turn it on for each supported browser or browser extension you use.

If you do not have a True Religion account, or if you are not logged into your True Religion account, your request to opt-out of selling/sharing will be linked to your browser identifier only and not linked to any account information, because the connection between your browser and the account is not known to us. This means that you will need to opt-out on each browser or device you use. If you would like us to make the connection between your browser and your account, please ensure that you are logged in to your True Religion account when requesting to opt-out of selling/sharing, or submit this form. Your browser may save some information in its cookies and cache to maintain your privacy preferences. Clearing these may remove opt-out preferences, requiring you to opt-out again. You can read more about targeted adverting and take additional steps to control targeted advertising from many ad networks and exchanges by visiting the Digital Advertising Alliance (www.optout.aboutads.info). You may also choose to control targeted ads you receive within apps by using the settings and choices made available to you by your device manufacturer.

We do not:

  • disclose personal information with third parties for those third parties’ direct marketing purposes;
  • respond to Do Not Track signals. We do, however, treat the Global Privacy Control as a valid form of opt-out of selling/sharing.

Microsoft Clarity and Microsoft Advertising

We improve our products and advertising by using Microsoft Clarity to see how you use our website. By using our site, you agree that we and Microsoft can collect and use this data.

We partner with Microsoft Clarity and Microsoft Advertising to capture how you use and interact with our website through behavioral metrics, heatmaps, and session replay to improve and market our products/services. Website usage data is captured using first and third-party cookies and other tracking technologies to determine the popularity of products/services and online activity. Additionally, we use this information for site optimization, fraud/security purposes, and advertising. Your Choices

Privacy Requests

Your rights and choices vary by the jurisdiction in which you reside. In addition to the choice to opt-out of selling/sharing discussed in the preceding section, True Religion also provides residents of the U.K., Canada, California, Colorado, Connecticut, Utah, and Virginia the ability to:

  • Know the information being processed about them;
  • Access their personal information, including receiving a copy in a portable format;
  • Correct inaccurate personal information;
  • Delete certain personal information (this includes UK and Canadian residents’ right to object, restrict, or withdraw consent, to the processing of their personal information); and
  • Not be discriminated against for exercising their privacy rights.

Exceptions apply to all of these rights, but if we deny your request, we will tell you why. You can also correct and/or delete personal information by logging into your True Religion account or speaking with a representative in one of our stores. You may delete your True Religion account at any time.

Eligible consumers, and authorized agents for California residents, may submit privacy requests by contacting us toll-free at 1-833-878-5327 or completing a web form at https://www.surveymonkey.com/r/29WHK6Q. California residents and their authorized agents may also print and submit this form at any one of our California retail locations.

When we receive a request to know, access, correct, cease processing, or delete your personal information, we must first verify your identity. We will take commercially reasonable steps to do so, including verifying you via your existing password-protected account or asking you to provide us with information matching the information we already have about you, such as by identifying a recent product you’ve purchased from us, the dollar amount of a recent purchase, or other such historical information about your purchases with us. If you wish to designate an authorized agent to make a request on your behalf, the agent should indicate that when submitting your request. We will then verify your authorized agent’s permission to act on your behalf, including by requiring that they provide a written authorization to do so.

There may be circumstances in which we need not grant your privacy request. For example, we are not required to delete personal information needed to complete the transaction for which the personal information was collected (such as completing a sale), to detect fraudulent or illegal activity, for bookkeeping or tax purposes, or for legal purposes. Also, we are not required to provide access, correction, or deletion where your identity could not be verified, where the information would compromise others’ privacy or other legitimate rights, like intellectual property rights, or where the information contains legally privileged material. If we determine that your request should be restricted in any particular instance, we will provide you with an explanation of why that determination has been made and a contact point for any further inquiries.

If you are a Colorado, Connecticut, or Virginia resident and we deny your privacy request, you may appeal our decision by contacting us in any of the ways listed in the “Contact Us” section below.

Managing Your Communication Preferences

Email. To stop receiving promotional emails, click the “unsubscribe” link in any of our marketing emails or adjust your email preferences in your True Religion account.

Direct Mail. To stop receiving promotional postal mail, contact us using any of the methods in the “Contact Us” section below.

Text Messages. To opt-out of our text program, text “STOP” in reply to any of our text messages.

App Push Notifications. To adjust your notifications, please adjust your selections in the TR App’s “Notification Settings.”


Complaints

If you have any concerns about our use of your personal information, please contact us using the methods in the “Contact Us” section below so we can help make it right. If you are unhappy about how we resolve your issue, you also have the right to complain to your local privacy regulator. Selected regulators’ contact information is shown below.

  • In the U.K., the regulator is the Information Commissioner’s Office (www.ico.org.uk), which you can call at 0303 123 1113.
  • Connecticut residents who have their privacy rights appeal denied can contact their Attorney General via email at attorney.general@ct.gov.
  • Colorado residents with concerns over how their privacy rights appeal was handled can contact their Attorney General at 720-508-6000 or here.

NOTICE OF FINANCIAL INCENTIVE

True Religion may provide one-time discounts, rewards, and exclusive offers for customers who sign up to receive communications from us, download the TR App, refer friends to us, participate in our student discount program, and/or enroll in the True Fam Loyalty Program. We may also provide sweepstakes, contests, or other similar promotional campaigns. Collectively, this policy refers to all of these discounts, programs, and promotions as “Programs.” Because our Programs involve the collection of personal information, they might be interpreted as a “financial incentive” program under California law. 

You may sign up to receive communications from us online, in-store or via the TR App by inputting your information into the Sites’ pop-ups or providing your information to your cashier during in-store checkout. The information we request from you when you sign up to receive communications includes your name, phone number, clothing preferences, and/or email address. You can opt-out of text communications at any time by texting “STOP” in response to our text message and opt-out of emails by clicking the unsubscribe button in our emails.

You can opt-in to our TR App program by downloading the TR App to your phone and inputting the code provided to you, during checkout. If you download the TR App, you are not required to provide any particular information, but we will collect personal information from you when you use the TR App. The data we collect depends on your TR App use and your particular device settings and choices. We collect a name, device identifier, app usage information (such as your in-app search history and data we use for analytics purposes), email address, and marketing preferences from all TR App users, but we will only collect information about your use of other apps and/or your location if you opt-in to such sharing. When you make a purchase or create or use a True Religion Account within the TR App, we collect the same personal information detailed in our Privacy Policy. You can opt-out of the TR App at any time by deleting the TR App.

You can participate in our Refer a Friend Program by visiting https://www.truereligion.com/true-fam-loyalty#loyalty-refer-friend which will give you an opportunity to edit the default message and send to your friend via your email, a coupon for $20 off $99+ purchase. You will also receive a $20 off $99+ purchase coupon code on your next order, if they shop with us using the code they received. Referred friends must be a first-time customer in order for you to receive your reward. Referred friends are not opt-ed into the True Fam Loyalty program or to receive any additional marketing communication, unless they sign-up themselves and opt-in to either.

You can enroll in our student discount program by creating an account by visiting https://www.truereligion.com/studentbeans and providing your email address and setting a password. To complete account creation, you will need to provide your full name, what pronouns you go by, and date of birth in order to create your digital Student Beans IiD. You will have an opportunity to op-in to receiving email marketing messages and will have to verify your student status by providing a graduation year and student email address or uploading an official, valid document from your educational institution. To delete your account, simply go to ‘My Account’ and a ‘Delete Account’ button should appear in the top right-hand corner. Once Student Beans receives your request to delete your account, it will be deactivated within 7 days. Once deactivated, any data will be deleted.

You can enroll in the True Fam Loyalty Program by creating a new account or signing into your existing Truereligion.com account and checking the box to opt into the program. The required information to setup an account includes an email address, first and last name, as well as creation of a qualifying password or entry of an existing truereligion.com password. Outside of email address, we collect and store your purchase history including how much you’ve spent on purchases, your birth date should you provide it, and social media accounts should you engage with our other methods of earning points that include social media follows. You can opt-out of our program by going into your account and selecting the option to Opt out and confirming action. Opting out of the True Fam Loyalty program does not automatically opt you out of receiving marketing communications.

The value of the discount, reward, or offer we provide you as part of your participation in our Programs depends on the special offer provided when you sign up, the amount you purchase using that special offer, the amount anyone you refer to us purchases, and the value of future special offers you receive from us and use to make purchases. While we do not assign a monetary value to the personal information we collect from you by including you in our Programs, or for your use of the TR App, we do receive value in the form of customer loyalty and increased purchase engagement. In determining the value to True Religion of your receiving communications from us, using the TR App, referring someone to us, or being enrolled in our loyalty or discount programs, we considered the revenue generated from activities related to this loyalty and engagement, minus the expenses related to providing and administering the communications, TR App, and Programs.


DOCUMENT RETENTION

We retain personal information for as long as needed or permitted for the purpose(s) for which we obtained it, and as consistent with applicable law. The criteria used to determine our retention periods include:

  • How long the personal information is needed to provide our products and operate our business;
  • The type of personal information collected;
  • How recently you made a purchase from us;
  • Whether you have an account with us;
  • Whether we are legally or contractually required to maintain your information for a certain period of time; and
  • Other legal considerations (e.g., statutes of limitations).

NON-UNITED STATES RESIDENTS

Please note that by using the Sites or otherwise engaging with us, you will be sending information (including personal information) to the United States where our servers are located. We will hold and process your personal information in accordance with privacy laws in the United States and this Policy. Please note that privacy laws in the United States may not be the same as, and in some cases may be considered less protective than, privacy laws in other countries. Therefore, by providing your personal information, you consent to the use of your personal information for the uses identified in this Policy and to the transfer of your personal information to the United States. Any transfer of U.K. consumer data to the United States is done according to the established Standard Contractual Clauses for international data transfers. Additional detail can be obtained by contacting us as described in the “Contact Us” section.

You may also have additional privacy rights based on your country’s privacy laws. See the “Your Choices” section of this Policy for more information.


HOW WE PROTECT YOUR PERSONAL INFORMATION

Although no website, app, platform, or business is 100 percent secure, the security and confidentiality of your personal information is important to us. We have implemented administrative, technical and physical controls designed to safeguard your personal information. We use various security measures, including Transport Layer Security (TLS) encryption technology, to protect information collected, transferred and retained. If you elect to set up an account on the Sites, you will be asked to provide an email address and password. You must provide a valid email address and password in order to create and maintain an account, as well as to access account information. We recommend that you select a password with at least 8 characters and consider adding numbers or special characters to further strengthen your password. In order to help protect your personal information, you should be careful about providing your password to others, and you should change your password periodically. If you wish to update a password or learn more about how we safeguard your information, or if you become aware of any loss, theft or unauthorized use of a password, please contact us at cs@truereligion.com.

We do not, and will not, at any time, ask you to provide your personal information in an unsolicited email or telephone communication. Identity theft and the practice currently known as "phishing" are of concern to us. If you receive an email from someone impersonating True Religion, please contact us to bring it to our attention. The Sites may contain links to other websites not operated or controlled by us (the "Third-Party Sites"). The policies and procedures set forth herein do not apply to any Third-Party Sites.
